In the matter brought by a real estate investor against a real estate investment company and other parties concerning a tower project located on Al Reem Island | Case No. 45 | of 2024 | Judgment Date: 9 July 2025 | Hearing Date: 9 July 2025
Our firm, through Dr. Mohammed Haitham Salman, had the privilege of representing the claimant before the Court of First Instance of the Abu Dhabi Global Market (ADGM). We rendered comprehensive legal representation throughout all stages of the proceedings, including the preparation and submission of legal memoranda and oral advocacy before the court. The proceedings culminated in a judgment in favor of the claimant, affirming his contractual rights under the real estate investment agreement executed between the parties, as well as his financial entitlements expended during the implementation of the real estate project. With respect to the enforcement of the aforementioned judgment, ADGM Court has sets a precedent where the claimant submitted several applications, including a request for the issuance of a power of attorney and the appointment of a judicial representative in connection with the disputed real estate project. The court issued an order compelling the defendant to execute a power of attorney in favor of the claimant, thereby enabling the claimant to exercise his contractual rights pursuant to the investment agreement, in coordination with the relevant stakeholders (the financier and the defendant), and to facilitate the execution of the court’s ruling. Consequently, the court denied the request for the appointment of a judicial representative, on the grounds that the claimant already possessed sufficient legal authority and that such an appointment could potentially have adverse effects on the project.
This ruling reinforces the principle of contractual enforcement and reflects the court’s orientation toward promoting cooperation among stakeholders in complex commercial ventures, thereby enhancing the judicial enforceability of such agreements in such cases.
