A will is a recommendation for a person to donate while alive to another individual or a charitable organization, to be executed after their death. According to Article 240 of the Personal Status Law in the United Arab Emirates, a will is a disposition of the estate that takes effect after death.
Under Federal Law No. 41 of 2022 concerning civil personal status for non-Muslims, the legislator specifies that the inheritor has the right to leave a will, designating the distribution of all their assets in the state to whomever they choose, subject to specific controls.
What constitutes a will? As per Article 1 of Law No. 14 of 2021, a will is a document in which individuals covered by this law express their desire to manage the disposal of their money and its distribution upon their death.
To ensure the legal validity of a civil will, it must be properly “registered.” This can be accomplished by submitting the relevant application and a copy of the will to the Civil Wills Section of the Judicial Department.
For assistance in drafting a will, the Abu Dhabi Civil Family Court has provided a unified will form in both English and Arabic. This form can be utilized to prepare a will effectively and economically. Alternatively, hiring a lawyer specializing in wills is another option, ensuring the proper registration of the document.
Can Muslims register a will? Regardless of religion, non-UAE citizens can register a will with the Abu Dhabi Civil Wills Office.
The benefits of registering and authenticating a will are significant. With a registered will, one can be assured that their property in the UAE will be distributed according to their wishes after death. Failure to register a will may result in delays in asset distribution and, in some cases, lead to conflicts among family members.
