ME-ALLIANCE LEGAL UPDATE
The United Arab Emirates aims to enhance the quality of life for individuals and families with limited incomes through social support. This initiative seeks to empower individuals to lead dignified lives and achieve social and financial independence, this decree-law aims to provide social protection.
With reference to the Unified Sales property contract Conditions for eligibility for basic and supplementary allowances:
1. The applicant must be a citizen of the country.
2. The applicant must be a permanent resident of the country.
3. The applicant must be at least 21 years old.
4. The total monthly income of the family must be below the eligibility threshold.
5. The total value of the family’s owned assets must be below the minimum asset limit.
The basic allowances for social support consist of:
1. The allowance for the primary beneficiary.
2. The allowance for the spouse.
3. The allowance for children under the age of 21, or up to 25 years if they are still pursuing higher education, married, or have completed national service.
Note: The intended ministry is the Ministry of Community Development.
Supplementary allowances include:
1.Housing Allowance: Provided if the primary beneficiary does not own a housing unit and does not receive financial support for housing from federal or local authorities, or if the support received is less than the designated housing allowance in this decree.
2.Academic Excellence Allowance: A monthly allowance granted to the children of the primary beneficiary for their academic achievements, based on conditions set by the Council of Education, Human Development, and Community.
3.Seasonal Allowance: An allowance granted during special occasions for the beneficiary.
Special categories that are subject to the eligibility conditions for support, exempt from age or employment requirements:
1.Orphans and children of convicted individuals in the absence of a mother or if she is not eligible for support, as well as those of unknown parentage.
2.People of determination (individuals with disabilities).
3.Widows, divorcees, abandoned spouses, wives of convicted individuals, and wives of foreigners unable to work.
Application for Social Support:
1.The application must be submitted to the ministry using the designated form along with documents that verify the accuracy of the provided data and information. The applicant must also provide a declaration confirming the correctness of the submitted information. The ministry will review and decide on the application within 30 days from the date all information and data have been completed.
2.The applicant is required to inform the ministry of any changes that may affect their eligibility for social support.
3.If the ministry approves the application, it will be registered and approved in the name of the primary beneficiary, and the beneficiaries from their family will be added. If the application is rejected, the ministry must provide a reason for the rejection.
Social Support Account:
1.The ministry will open a bank account within the country in the name of the primary beneficiary and will deposit the support monthly. Payments will be disbursed to the primary beneficiary personally, although an authorized representative may submit the application or collect the support.
2.In the event of the primary beneficiary’s death, social support payments will cease in the month following their death, and any amounts in the social support account will need to be refunded.
3.If there are other beneficiaries of the social support, the allowance for the primary beneficiary will be halted in the month following the death. The ministry will assess the situation of the deceased’s family members within (30) days of the primary beneficiary’s death, and allowances for the beneficiaries will continue.
