In line with the Emirate of Abu Dhabi’s efforts to strengthen environmental protection and ensure the preparedness of facilities to address emerging environmental challenges, the Environment Agency – Abu Dhabi (EAD) has issued Resolution No. (5) of 2025 concerning the Regulatory Framework for Environmental Emergency Preparedness and Response. This regulation aims to enhance environmental safety systems and minimize potential adverse impacts on the environment and public health by regulating the obligations of entities and facilities operating within the Emirate. It establishes a comprehensive operational framework for managing environmental incidents across all levels. The regulation represents a significant step forward in institutionalizing emergency environmental responses through clearly defined roles, improved coordination among relevant authorities, and activation of emergency plans to ensure rapid crisis response and mitigate impacts.
Key Provisions of the Resolution:
1. Obligations of Facilities/Projects:
✔️Implement preventive measures to avoid environmental harm resulting from emergencies.
✔️Maintain an up-to-date environmental risk register.
✔️Provide emergency equipment and ensure readiness to manage potential incidents.
✔️Develop an environmental emergency response plan in accordance with Annex (1).
✔️Promptly notify the Agency of any environmental incident in accordance with its severity (High – Medium – Low).
2. Classification of Environmental Emergencies:
✔️Level One (Red): High severity – requires declaration of a state of emergency and full-scale intervention.
✔️Level Two (Yellow): Medium severity – requires coordination with the relevant sector within 24 hours.
✔️Level Three (Green): Low severity – requires notification within 72 hours.
3. Responsibilities of the Environment Agency:
✔️Classify projects based on environmental risk levels.
✔️Approve emergency response plans submitted by facilities.
✔️Coordinate governmental efforts during environmental incidents.
✔️Monitor and implement necessary technical measures following incidents.
4. Accountability and Penalties:
In cases of non-compliance with the regulation, the Agency is authorized to take the following actions:
✔️Issue warnings, notifications, or activity suspensions.
✔️Revoke licenses and temporarily or permanently shut down the facility or project.
