ME-ALLIANCE LEGAL UPDATE
The UAE prioritizes enforcing laws that ensure the safety of drivers and road users and reduce accidents and promote safe driving by rigorously applying and updating traffic regulations.
Federal Decree-Law No. (14) of 2024 has been issued concerning the regulation of traffic rules and regulations. Its provisions apply to all types of vehicles and their drivers, as well as to pedestrians while crossing the roads. This decree includes the new amendments that have been made to previous laws including:
1. Reducing the legal age for obtaining a driving license to 17 years.
2. The Cabinet will issue a detailed decision regarding the conditions and procedures for inspecting, registering, and renewing self-driving vehicles in the country.
3. Restriction of the current paneities , for example:
• Anyone who drives a vehicle on the road during the period of suspension of their driving license, based on an order from the competent court, licensing authority, or traffic control authority, shall be punished with imprisonment for a period not exceeding three months, and a fine of no less than 10,000 dirhams, or one of these penalties.
• Anyone who flees the scene of an accident and refuses to provide information shall be punished with imprisonment for a period not exceeding one year, and a fine of no less than 50,000 dirhams and no more than 100,000 dirhams, or one of these penalties.
• Anyone who crosses the road outside of designated areas and causes a traffic accident as a result shall be punished with imprisonment and a fine of no less than 5,000 dirhams and no more than 10,000 dirhams, or one of these penalties.
• Anyone who causes the death of a person by mistake because of using a vehicle shall be punished with imprisonment and a fine of no less than 50,000 dirhams, or one of these penalties, in addition to the registration of 24 traffic points.
• Anyone who crosses outside the designated areas on roads with a speed limit of 80 kilometres per hour or more shall be punished by imprisonment for no less than three months and a fine of no less than 10,000 dirhams, or by one of these penalties.
• Anyone who refuses to disclose accurate personal information shall be punished with imprisonment for a period not exceeding three months, and a fine of no less than 10,000 dirhams and no more than 20,000 dirhams, or one of these penalties.
• Anyone who misuses a license plate shall be punished with imprisonment and a fine of no less than 20,000 dirhams, or one of these penalties.
4. A council called the “Federal Traffic Council” shall be established under this decree-law. The Cabinet shall issue a decision to form it, define its functions, and determine its operating system based on the proposal of the minister.
5. The Cabinet shall issue the executive regulations for this decree-law within six months from the date it comes into effect.
6. The decisions issued prior to the enforcement of this decree-law shall remain in effect, to the extent that they do not conflict with its provisions, until replacements are issued in accordance with the provisions of this decree-law.
7. Federal Law No. (21) of 1995 regarding traffic and its amendments shall be repealed, as well as any provision that contradicts or conflicts with the provisions of this decree-law.
8. The Council of Ministers shall define the violations and administrative penalties for acts that contravene the provisions of this decree law, and the decisions issued in implementation thereof, as well as the authorities responsible for imposing administrative penalties, the mechanisms for appealing against them, and the entity responsible for collecting the administrative fines.
9. The decree-law will come into effect on March 29, 2025.
